A009. TARIFF REGULATIONS

 

1.      General

 

These Regulations prescribe the procedures by which the charge for air navigation services within the Riga Flight Information Region and the airport of the State stock Company "Riga International Airport" (hereinafter - Riga Airport) shall be determined.

 

2.      Air Navigation Services Charges

 

The charge for the air navigation services provided by the Latvian national air navigation service provider - the State Joint Stock Company "Latvijas gaisa satiksme" (hereinafter - LGS) within the Riga Flight Information

Region shall be determined as follows:

 

2.1.    the charge for air navigation services within the Riga Flight Information Region and for Latvian Republic delegated air space on the basis of the maximum take-off weight (MTOW) of aircraft in tons (with an accuracy

of two digits after the comma, rounding up) shall be calculated using the following formula:

 

R = P x D x W, where

 

R - the charge for en-route air navigation services;

 

P - national unit rate within the Riga Flight Information Region - EUR 29,44 or the equivalent sum in LVL in accordance with the exchange rate specified by the Bank of Latvia. The unit rate for international routes which the Central Route Charges Office of the European Organisation for the Safety of Air Navigation (hereinafter - Eurocontrol CRCO) shall collect upon being commissioned by LGS is EUR 29,44 or the equivalent sum in LVL in accordance with the exchange rate specified by the Bank of Latvia plus the administrative rate of the Eurocontrol CRCO. LGS shall inform the air space users on changes of the administrative unite rate of the Eurocontrol CRCO before their coming into force.* ;

 

D - 1/100 part of the distance covered within the Riga Flight Information Region, which shall be re-calculated according to the great circle distance and expressed in kilometres (with an accuracy of two digits after the comma). The distance to be taken into account shall be reduced by 20 kilometres for each take -off from and for each landing on the territory of Latvian Republic;

 

W - aircraft weight factor (with an accuracy of two digits after the comma), which is calculated as the square root of the quotient that is obtained by dividing the number of metric tons of the maximum certified take-off weight (MTOW) of the aircraft referred to in the certificate of airworthiness, in the flight instructions or another similar official document by 50:

 

*. The administrative unit rate and interest rate on late payment for service for international routes which the Eurocontrol CRCO collects upon bilateral agreement between LGS and Eurocontrol CRCO are:
    - administrative rate - EUR 0,42
    - interest on late payment - 11.58 percent


 

 

2.2.    the charge for air navigation services within the terminal control area shall be calculated using the following formula:

 

A = P x K, where

 

A – the charge for the air navigation services provided within the terminal control area;

 

P – service unit rate - EUR 89,72 or the equivalent sum in LVL in accordance with the exchange rate specified by the Bank of Latvia;

 

K – the weight factor, expressed as a figure taken to two decimal places, shall be the quotient, obtained by dividing by fifty the number of metric tons in the highest maximum certified take-off weight of the aircraft, to the power of 0.7.

 

 

3.  The charge for the services provided by the Riga International Airport shall be determined as follows:

 

3.1. aircraft take-off and landing fees:

 

3.1.1. aircraft take off and landing fees - EUR 2.05 or equivalent amount in LVL in accordance with the exchange rate specified by the Bank of Latvia for every 1,000 of the aircraft maximum take-off weight in kilograms (rounded up to 10 kg) for each aircraft take off and landing;

 

3.1.2. a training flight hour shall be equivalent to one take-off and landing, and the coefficient 0,75 shall be applied for each following hour;

 

3.2. parking fees:

 

3.2.1. the first hour shall be free of charge;

 

3.2.2. for the second and each subsequent hour for every 1,000 of the aircraft maximum take-off weight in kilograms determined fee - EUR 0.14 or equivalent in LVL in accordance with the exchange rate specified by the Bank of Latvia. The minimum payment for the aircraft parking in operational aircraft parking area - EUR 30 or equivalent in LVL in accordance with the exchange rate specified by the Bank of Latvia;

 

 

3.3. passengers service fees:

 

3.3.1. for each departing passenger LVL 2.18 or equivalent amount in EUR in accordance with the exchange rate specified by the Bank of Latvia;

 

3.3.2. for each transiting and transferring passenger LVL 0.70 or equivalent amount in EUR in accordance with the exchange rate specified by the Bank of Latvia;

 

4. Payment shall not be required for the services referred to in Paragraphs 2 of these Regulations if the following flights are made:

 

4.1. according to part 1 clause 9 of EC regulation No. 1794/2006, dated 6 December 2006, on the unified tarification system for air navigation charges;

 

4.2. if flights are performed:

 

4.2.1. by military aircraft of Latvia or any other country;

 

4.2.2. customs or border guard flights;

 

4.2.3.  flights performed in the Riga Flight Information Region in accordance with visual flight rules outside the borders of controlled airspace.

 

5. Payment shall not be required for the services referred to in Paragraphs 3 of these Regulations if the following flights are made:

 

5.1. flights performed exclusively for the transport, on official mission, of the reigning Monarch and his immediate family, Heads of State, Heads of Government and Government ministers;

 

5.2. flights intended for search and rescue operations upon an order of a competent aviation search and rescue service;

 

5.3. flights with State aircraft within the meaning of Article 3 of the Convention on International Civil Aviation of 7 December 1944, including flights with military, customs or border guard aircraft.

 

6. Passengers who have not reached 2 years of age shall be exempt from the charges referred to in Subparagraph 3.3.1 and 3.3.2 of these Regulations.

 

7.  Payment for air navigation and Riga airport services:

 

7.1. the charge referred to in Paragraph 2 of these Regulations shall be collected by the LGS, and the charge for air navigation services provided on international routes in the Riga Flight Information Region may be collected by the Eurocontrol CRCO upon being commissioned by the LGS;

 

7.2. the owner and the user of an aircraft shall be equally liable for payment for received services;

 

7.3. payments shall be made within a time period of 30 days from the moment of the sending of the invoice. If the deadline for payment is a Saturday, Sunday or an official holiday of the Republic of Latvia, the payment shall be made on the following working day;

 

7.4. charter flights payment shall be made after landing in the territory of Latvia in the Air Traffic Information Centre of the LGS, the control centre of the Riga airport or in the nearest subsidiary of a bank, if it has not been specified otherwise in an agreement;

 

7.5. payment delays will be subject to interest on late payment of 0.05 percent of the outstanding principal sum for each day of delay.

 

Paragraph 2 of these Regulations enters into force 01 February 2010
